Julian Eckert – the guy that the defense put on the stand to rebut testimony by metadata expert Bryan Neumeister – seemed to be a completely full of shit career liar for one law firm, and it also seemed that the prosecution missed the boat on the cross examination.
Eckert seemed to claim that just sorting photos in the Apple Photos would change the metadata information of the images, which we do not believe to be the case.
Apple Photos does not edit metadata when you sort your photos. The only way that we know of to change the “Software” field of the EXIF metadata to “Photos 1.5” or “Photos 3″is to actually save another version of the image using the software indicated in the “Software” EXIF field.
In my opinion, the prosecution did a shitty job of highlighting the fact that the darker images are all saved using the Apple Photos application, and that the original photos that showed that they were taken by Amber’s phone were far lighter =- which tells anyone with a brain that the defense …
