$1 MILLION LAWSUIT FLED AGAINST WOODSON & THE CITY OF STURGEON

The owner, whose dog was shot and killed by a Sturgeon police officer, has filed a federal lawsuit against the officer and the city, claiming a violation of the Fourth Amendment.

KOMU 8 obtained a copy of the lawsuit filed Tuesday by attorneys based in St. Louis and Kansas City on behalf of Nicholas Hunter. The suit names Officer Myron Woodson and the city of Sturgeon as defendants.

On May 19, Woodson encountered a Shih Tzu named Teddy, which Woodson said was acting erratically. Woodson shot and killed the dog after “numerous attempts” at capture failed, according to a statement from the city. The statement also said Woodson worried the dog was “severely injured or infected with rabies.”

The lawsuit claims Woodson violated Hunter’s Fourth Amendment right to protection against “unreasonable… seizures.”

“As defined by the United States Supreme Court, a Fourth Amendment seizure of property occurs whenever the is ‘some meaningful interference with an individual’s possessory interests in that property,'” the lawsuit says. “As repeatedly recognized and well-established by the federal courts, the seizure of a family pet and dog by killing him/her can give to a claim for an unlawful seizure in violation of the Fourth Amendment.”

The lawsuit claims the dog was not a threat, and that Woodson would have been able to capture him with non-lethal means.

The suit also alleges municipal liability, arguing the city is responsible for Woodson’s actions since he took them while in an official capacity. It claims any policies or training regarding animal control that Sturgeon may have were inadequate.

The shooting led to a large response from the Sturgeon community, with some signing a petition to have Woodson removed from his position. Woodson is currently on leave. On May 25, nearly a week after the incident, the mayor of Sturgeon announced his resignation.
